Election committee chairman Damas Ndumbaro declared Wambura’s disqualification on the basis of his default membership.
Ndumbaro, a well versed in law with a doctorate tag said Wambura’s membership was suspended on May 5, 2010 for opening a case against Simba leadership at the Kisutu Court in Dar es Salaam.
‘Our committee has been satisfied that Wambura opened a case number 100/2010 at the Kisutu Resident Magistrate Court in Dar es Salaam in contrast to section 11(1) (e), (2), 12(3) and 55 of Simba SC of 2010, which disqualifies him from aspiring for any election post in the club’, said Ndumbaro.
Ndumbaro said Wambura presented a letter to Simba chairman on November 6, 2012 while acknowledging his mistake and queried over his membership status after the action.
Ndumbaro said Wambura presented another letter to the club on September 15, 2012 conceding that he has membership crisis.
‘There are controversies to this problem and his third letter dated September 25, 2012 declared that he has no problems with Simba. The committee has decided to forward these three letters to the integrity committee for further action’ said Ndumbaro.
The election committee also discovered that Wambura was at one time appointed to the executive committee of the club without valid membership.
However, Wambura has been given an opportunity to lodge an appeal over the decision taken by the election committee, so says Ndumbaro.
Wambura responded by saying he head of election development and will unveil action to be taken today at a press conference.
Five Simba members had filed a petition to Wambura’s quest to vie for presidency in the election and the members included Seydou Rubeya, Mohamed Hassan, Valentino Nyayo, Swalehe Madjapa and Jackson Sagonge on grounds of questionable integrity.
The rest of candidates who have been petitioned have been cleared by the committee. Ndumbaro said all of his election committee members have been threatened through sms and live telephone calls.
